Terms of Service for HashDB API

Welcome to the HashDB API. These Terms of Service ("Terms") govern your access to and use of the HashDB API and related services (collectively, the "API Service"). By accessing or using the API Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the API Service.

1. Acceptance of Terms

By accessing or using the API Service, you represent that you have read, understood, and agree to be bound by these Terms, including any future modifications. If you are using the API Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.

2. Description of Service

The API Service provides developers with access to the MSISDN hash lookup on a freemium basis.

1. Beta Tier: Each user account is granted a limit of 100 API requests per day free of charge. The Beta programme will run from 1st May 2025 to 31st May 2025, after which all Beta Tier users will be moved to the Free Tier.
2. Free Tier: Each user account is granted a limit of 10 API requests per day free of charge.
3. Paid Tier: Once the daily free request limit is exceeded, subsequent API requests will be charged at a rate of KES 0.20 per API call.

3. API Usage and Limits

You agree to use the API Service in accordance with any documentation or guidelines provided by HashDB. You agree not to:

1. Exceed the free daily request limit without intending to incur charges for additional usage.
2. Use the API Service for any illegal or unauthorized purpose.
3. Attempt to gain unauthorized access to the API Service or its related systems or networks.
4. Interfere with or disrupt the integrity or performance of the API Service.
5. Reverse engineer or attempt to extract the source code of the API Service.

HashDB reserves the right to monitor your usage of the API Service and may suspend or terminate your access if you violate these Terms or if your usage is deemed excessive or harmful to the service.

4. Billing and Payment

1. Billing Cycle: Usage exceeding the free daily limit will be tracked and billed on a monthly basis.
2. Invoicing: You will receive a monthly invoice detailing your usage and the total charges incurred during the billing cycle.
3. Payment: Payment for services rendered is due within 30 days of the invoice date. Payments should be made using bank transfers or M-Pesa as described in the issued invoice.
4. Late Payments: Late payments may be subject to suspension of service.
5. Taxes: All fees are exclusive of applicable taxes, which may be added to your invoice.

You are responsible for providing accurate billing and contact information and for keeping it up to date.

5. User Accounts

To access and use the API Service, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify HashDB immediately of any unauthorized use of your account.

6. Intellectual Property

The API Service, including its design, code, and documentation, is the exclusive property of HashDB and its licensors. These Terms do not grant you any rights to use any trademarks, logos, or other intellectual property of HashDB.

7. Disclaimer of Warranties

THE API SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HashDB DOES NOT WARRANT THAT THE API SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HashDB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE API SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE API SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Indemnification

You agree to indemnify and hold harmless HashDB and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the API Service or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.

11. Changes to Terms

HashDB reserves the right to modify these Terms at any time. If we make changes, we will notify you by revising the date at the top of the Terms and, in some cases, we may provide you with more prominent notice (such as adding a statement to our website or sending you an email notification). Your continued use of the API Service after such changes have been made constitutes your acceptance of the revised Terms.
